Description of
the right

Filing a declaration of birth with the registrar of civil status gives the baby a social existence. It confirms their right and their parents’ identity. It is mandatory and must be done within 30 days following the birth.

The establishment where the birth took place provides the mother, father or other parent with the necessary documents and instructions. If the birth took place without the assistance of a health professional, the person who gave birth can go to the hospital or birthing centre with the baby to obtain a report confirming the birth. The person can also apply directly to the Registrar of Births, Marriages and Deaths to obtain a declaration of birth.

A declaration of birth can include a maximum of two parents, who can be of the same sex. Registering only one parent may limit the possibilities of receiving child support. You can consult the section Help and Resources to find a legal resource able to give you more information.

The father or other parent who was not included in the declaration of birth may request to be added by providing proof of their parenthood.

In the case of a birth resulting from sexual assault, special rights apply. Don’t hesitate to consult a legal resource to learn more.
